SMS Consent & Communications Policy

NexVoice helps clinics send automated SMS replies to missed callers. This policy explains the consent, opt-out, and delivery rules that apply to every message sent through the platform.
1. Consent to receive messages
By contacting a business that uses NexVoice — for example by calling its phone number — recipients agree to receive automated SMS responses related to their inquiry, including appointment, scheduling, follow-up, and informational messages. Message frequency varies. Message and data rates may apply.
As the clinic, you represent that every recipient you message through NexVoice has provided the consent required by the TCPA, CAN-SPAM, state law, and any other applicable regulation.
2. STOP & opt-out handling
- STOP, STOPALL, UNSUBSCRIBE, CANCEL, END, QUIT — recipients are unsubscribed immediately and receive a one-time confirmation. No further messages are sent.
- HELP, INFO — recipients receive a help reply with the business name and a way to reach support.
- You must not attempt to bypass opt-outs or re-enroll recipients without fresh, documented consent.
3. Carrier delivery
SMS delivery is provided through Twilio and dependent on carriers, recipient handsets, regional rules, and 10DLC, toll-free, or short-code registration. NexVoice does not guarantee that any specific message will be delivered, delivered in any specific window, or delivered without filtering.
4. Prohibited content
- No SHAFT content (sex, hate, alcohol, firearms, tobacco) and no cannabis, gambling, or controlled-substance promotions.
- No deceptive, misleading, or unsolicited marketing without prior express written consent.
- No transmission of protected health information ('PHI') without the patient consent your jurisdiction requires.
- No URL shorteners or shared links that violate carrier filtering policies.
5. Recordkeeping
You are responsible for keeping records of consent, opt-out, and message content for at least four (4) years or as required by law. NexVoice retains message logs per your plan and may produce them in response to lawful requests.
