HIPAA & Healthcare Disclaimer
Effective May 27, 2026
NexVoice provides automation tools used by healthcare practices, but you remain the Covered Entity responsible for HIPAA compliance in your jurisdiction. This page explains what that means and what NexVoice does and does not do.
1. Your responsibilities as a Covered Entity
- Obtain all consents required to send SMS, voicemail, and automated communications to patients.
- Configure NexVoice so that protected health information ('PHI') is not transmitted in outbound SMS unless your patients have consented and your workflows allow it.
- Review AI-generated content before relying on it for patient care or scheduling.
- Maintain your own HIPAA policies, training, breach response plan, and Business Associate Agreements where required.
2. Business Associate Agreements (BAA)
Standard NexVoice plans are not sold with a BAA. If your use case requires a BAA, contact us at aastheticcx@gmail.com to discuss eligibility and available enterprise terms. Without a signed BAA in place, you must not transmit PHI through the Service.
3. What NexVoice does not guarantee
- We do not guarantee that any SMS will reach a patient or be delivered within a specific time. Delivery depends on carriers and third-party providers.
- We do not guarantee the clinical accuracy, completeness, or appropriateness of AI-generated text.
- We do not guarantee uninterrupted service, and we are not liable for missed appointments, lost revenue, or business interruption.
4. Emergency disclaimer
The Service is not designed for emergency triage. If you receive a message from a patient indicating an emergency, your staff is responsible for instructing them to call 911 or seek immediate in-person care.
5. Data handling
See our Privacy Policy for how we store and process information. You remain responsible for assessing whether NexVoice's safeguards meet your regulatory obligations under HIPAA, HITECH, state laws (e.g., CMIA), and any applicable international standards.
